In addition to Rice vs. Greentree Servicing LLC (Ditech is Green Tree) I've found other borrowers that have similar claims, that Ditech refuses to remove PMI timely. In addition, I've found borrower's who've attempted to paydown their principle while Ditech has held these funds in a suspense account.

On September 6, 2017, I served Ditech Financial LLC with a complaint containing sixteen RESPA violations for their failure to respond to my Qualified Written Requests, Notices of Error and Requests for Information and one violation of the Homeowner's Protection Act of 1998. for failure to terminate PMI when my loan had reached 78% LTV.
My counsel withdrew from the case in July 2018. Since that time, I've discovered a motive for the HPA violations, that being the captive reinsurance policy between Ditech and United Guaranty. Thus I'm in the process of amending the complaint to add Defendants Fannie Mae and United Guaranty as well additional causes of actions alleging RICO, breach of contract, fraud, negligence, unjust enrichment, and intentional infliction of emotional distress to name several. The final list will be on the amended complaint.
Right now, the case is before the court on Ditech's motion to dismiss. The first amended complaint containing the aforementioned allegations is forthcoming.
